ICE Issues Warning on Federal Assault Charges for Violence on Officers
US Immigration and Customs Enforcement declared on Tuesday that anyone who attacks its personnel will face serious criminal prosecution. ICE officials stressed that this applies to all individuals, regardless of their immigration status.
Sweeping Terms Raises Concerns Over Protest Activities
This statement may allow prosecutors to initiate criminal cases for behaviors that might otherwise be categorized as resisting arrest or demonstration activities. Embedded within the official post was an image with the phrase “think before you resist” alongside a raised fist.
DHS Expands Definition of Threats
Kristi Noem has stated that “violence” includes filming ICE operations and revealing personal information of agents. This widened view has recently resulted in the arrest of journalists, such as Mario Guevara, who was held for documenting an agency operation.
“Anything that threatens [DHS agents] and their safety constitutes a threat.”
Claims of Increased Incidents Met With Skepticism
DHS claimed that assaults on ICE officers had risen by a thousand percent, though when asked for specific examples, authorities cited incidents such as trash dumped on an agent’s lawn and insulting posters. In one case, the Federal Bureau of Investigation offered a bounty of $50,000 for information leading to the capture of an person who appeared to fire a gun during a West Coast operation.
Recent Judicial Changes Enable Expanded Enforcement
A Supreme Court ruling has removed restrictions that previously limited ICE power in the state, prompting DHS to announce it would “flood the zone” in LA. At the same time, deadly encounters during enforcement actions have persisted, including a recently reported officer-involved incident in Chicago.
Government attorneys have additionally brought criminal complaints against multiple protesters this year, with some instances involving actions that traditionally fall under resisting arrest.
